Las Vegas Teen Sentenced To Prison For Killing 10-year-old In DUI Crash

A 17-year-old will face three to 20 years in prison for driving drunk and killing a 10-year-old boy who was a passenger in another vehicle.

On February 3, Henrry Norberto pleaded guilty to driving under the influence, which resulted in death or substantial bodily harm.

According to court documents, the Clark County District Attorney’s Office and Norberto’s defense attorney agreed on a jail term ranging from three to fifteen years. On Monday, however, Clark County District Court Judge Mary Kay Holthus sentenced him to three to twenty years in prison.

“Kids going to prison is bad.” Kids going to the cemetery is worse,” Holthus said.

Brandon Martinez’s parents, however, expected at least ten years in prison.

“Every day, we wake up with the heartache that Brandon is no longer with us, and that we did not receive the justice that he deserves,” Brandon’s mother, Amy Davila, said after Norberto was sentenced. “Our justice system is a joke.”

Norberto was 16 years old when the tragedy occurred. Martinez died on June 28, 2025, near the I-15 corridor and the Las Vegas Speedway.

According to Nevada State Police, Norberto was driving a Ford F-250 pickup truck south in the northbound lanes when he collided with a Chevrolet pickup vehicle. Brandon’s father was driving the Chevrolet, and he was seated in the passenger seat.

According to Clark County prosecutors, Norberto was under the influence of marijuana and alcohol while driving on the wrong side of the roadway.

Davila was frustrated and disappointed with the judges and prosecutors in her son’s case.

“These are the people who are supposed to be protecting our families, who are supposed to be protecting our kids,” Davila told the crowd.

Norberto will be given 262 days credit for time already served in the Clark County Detention Center, allowing him to be released in two years for killing Brandon.

“We have to face this horror every day. Our son is not with us. My youngest Christian doesn’t have a brother, so our family is simply incomplete,” Davila explained.

During Norberto’s court appearance, Davila displayed a framed portrait of her son Brandon. His father wept in court as Norberto apologized.

“I hope I can be forgiven by my family and everyone else I’ve affected. “I know an apology will not change anything,” Norberto stated.

Norberto will also be required to pay reparation of around $16,000 to Martinez’s family. Davila suggested that people pay greater attention to who they vote for as judges and Clark County District Attorney.
